FAIR LABOR STANDARDS ACT ANALYSIS Purpose: The surveyor, in a supervisory role, must be cognizant of the Fair Labor Standards Act and how pay and a firm's profit may be

affected by the firm's decisions regarding the time and use of employees. Background: The employees are hourly employees, paid $15 per hour. They are paid bi- weekly. The multiplier for the firm is 2.0. Analysis: In a memo, determine and analyze each option in regard to the fair labor standards act and the effect on employee pay. Situation 1: A survey job is two-hour drive from the firm's office but only an hour's drive from an employee's home. Situation 2: The firm is busy and in danger of running behind contracted scheduling. One client informs the firm that he needs his surveying services completed by Monday and would be willing to pay extra for an employee to work the weekend (two, 8 hour days) to finish his project. Given the projects the firm must complete in the next few weeks, the firm cannot afford to give the employee comp time off. What should the client be charged and how much should the employee be paid to work the weekend? Situation 3: An employee would like to take a day off on Wednesday in two weeks without taking a vacation day and without losing any pay. The employer does not want to incur any extra expense or lose the work time of the employee. What options can the employer offer the employee without violating the FLSA? Situation 4: The employer has contracted to provide services near Huntsville, Alabama. Huntsville, Alabama is 2 hours, one-way, from the office. The services will require 40 hours of time for one employee. The services must be completed in five working days or less from the start of the project on Monday morning. Would it be more economical for the employer to pay overtime to cover travel time or pay per diem and lodging. Because of safety concerns the employer will not allow a four day, 10 hour workday coupled with 4 hours of driving for the employee. The employer will allow a four-day, 10 hour workday if there is minimal driving to and from the project site. 1
