The Case: Karma is a swimming trainer. She was requested to train for swimming a little girl called Jenna. During the session, she received a call from her sister who

asked Karma to share with her a contact number. While Karma was busy on her phone, Jenna jumped on her own into the swimming pool and she would have been drowned if another trainer, Sam, had not seen her and saved her on time. Jenna was heavily affected physically and emotionally. Jenna parents have paid around USD 10,000 for her medical treatment. a) Jenna's parents would like to sue Karma for reparation for the damages caused to their daughter and are asking you the following: Can they sue Karma for the harm caused to Jenna (and the medical fees spent) based on the tort of negligence? Please explain your answer by applying all the conditions of the tort of negligence (60 marks) b) Because of his intervention to save Jenna, Sam (the other trainer) has harmed badly his arm while pooling Jenna out of the swimming pool. Sam had also to pay around USD 7,000 to treat his arm and has lost his income for more than 3 weeks as he could not work during that time because of his injury. Can Sam sue Karma based on the tort of negligence for his arm injury (medical fees) and the loss of income during his sick leave?Please explain your answer by applying all the conditions of the tort of negligence (40 marks)
